These Terms of Use ("Terms") form a binding agreement between you and Lilith Studios LLC, a Wyoming limited liability company ("Lilith Studios," "we," "us," or "our"). They govern your access to and use of DarkRomanceWrite, including its website, applications, writing tools, AI-assisted features, account services, and related offerings (collectively, the "Service").
Please read these Terms carefully. By creating an account, accepting these Terms, or using the Service, you agree to be bound by them. If you do not agree, do not create an account or use the Service.
1. Who We Are and What These Terms Cover
DarkRomanceWrite is an AI-assisted writing studio operated by Lilith Studios LLC. It is designed to help adult authors plan, organize, draft, revise, and manage fiction projects.
These Terms apply to the Service and to all features made available through it. Additional terms presented for a specific purchase, feature, or promotion also apply to that transaction. If additional terms conflict with these Terms, the additional terms control only for the relevant transaction or feature.
2. Acceptance of These Terms
You accept these Terms when you affirmatively agree to them during account creation or when we otherwise present them for acceptance.
Our Privacy Policy explains how we handle personal information. Our AI Policy explains the principles that apply to AI-assisted features. Our Data Deletion Policy explains how account deletion and related data handling work. Please review those documents before using the Service.
You may not use the Service if you are unable to enter into a binding agreement with us or if applicable law prohibits you from using it.
3. Eligibility and Account Security
The Service is intended only for people who are at least 18 years old. By creating an account or using the Service, you confirm that you are at least 18.
You must provide accurate account information and keep it current. You are responsible for safeguarding your login credentials and for activity performed through your account, except to the extent caused by our failure to meet our legal obligations.
You may not share, sell, transfer, or make your account available to another person. Tell us promptly at security@darkromancewrite.com if you believe your account or credentials have been compromised.
4. How the Service Works
The Service provides tools that may help you develop story concepts, characters, settings, outlines, Story Bible material, scenes, chapters, revisions, and other elements of a writing project.
Features may use automated systems and third-party technology to process your instructions and return suggestions or generated material. Available tools, writing voices, models, limits, and export options may vary by plan, account status, or feature.
You decide whether, when, and how to use each feature. You remain responsible for saving independent copies of work that is important to you.
5. AI Assistance and Creative Control
DarkRomanceWrite assists the author. It does not replace the author.
You control your creative decisions. You may accept, reject, edit, rewrite, combine, or delete any AI-assisted suggestion. You choose the final plot, characters, themes, voice, language, intensity, and text that you keep, publish, or share.
No AI-generated suggestion is automatically part of your manuscript unless you choose to use it. You remain responsible for reviewing and approving the final work.
6. Nature and Limitations of AI Output
AI-generated material may be inaccurate, incomplete, inconsistent, repetitive, unexpected, offensive, or unsuitable for your intended use. It may also resemble material generated for other users because AI output is not necessarily unique.
You must review output before relying on, publishing, distributing, or commercially using it. You are responsible for checking facts, continuity, originality, permissions, and compliance with applicable law.
The Service does not guarantee that any output is copyrightable, registrable, exclusive, non-infringing, error-free, or suitable for publication. AI output is not legal, medical, financial, mental-health, or other professional advice.
7. Your Content and Ownership
"User Content" means the prompts, notes, Story Bible material, characters, settings, outlines, scenes, chapters, manuscripts, files, edits, and other material that you submit, create, import, or store through the Service. "Output" means material generated by the Service in response to your instructions.
You retain all rights you hold in your User Content. Lilith Studios does not claim ownership of your manuscript.
As between you and Lilith Studios, and to the extent permitted by applicable law, you may use Output generated for you for personal or commercial purposes. To the extent Lilith Studios may hold any rights in that Output, we assign those rights to you. This does not create rights in third-party material, guarantee copyright protection, or make non-unique Output exclusive to you.
You represent that you have the rights and permissions needed to submit User Content and to direct us to process it. You remain responsible for the final content you publish or distribute.
8. Limited Technical License
You grant Lilith Studios a limited, non-exclusive license to host, transmit, process, reproduce, format, and display User Content only as reasonably necessary to:
- provide the features you request;
- save, synchronize, restore, or export your work where those functions are available;
- maintain the security, integrity, and reliability of the Service;
- prevent fraud, abuse, or technical failure; and
- comply with applicable law.
This license is for operating the Service. It does not authorize us to publish, sell, advertise with, or commercially exploit your manuscript.
We do not use your User Content to train AI models. The license ends when the relevant User Content is deleted from the Service, except for limited copies or records retained as described in our Privacy Policy and Data Deletion Policy or as required by law.
9. Manuscript Confidentiality and Human Access
Your protected manuscript workspace is private. Lilith Studios personnel, including support staff, administrators, and company leadership, cannot open or read the protected manuscript content stored in that workspace.
When you request an AI-assisted operation, the relevant text is processed automatically by the systems needed to perform that request. Automated processing is not human manuscript review.
AI requests are routed using controls that require provider data collection to be denied and Zero Data Retention to be enabled. If no compliant route is available, the request is not sent. Neither Lilith Studios nor its AI providers may use your manuscript to train AI models.
If you voluntarily copy an excerpt into a support, privacy, security, or legal message, the recipient can read only the material you choose to send. You are never required to send an entire manuscript.
We use technical and organizational safeguards designed to protect the Service and User Content. No internet service can guarantee absolute security, so you should also keep independent copies and protect your devices and account credentials.
10. Responsible Use and Lawful Creative Freedom
DarkRomanceWrite supports lawful fiction for adults, including romance that explores dark, intense, violent, morally complex, or sexually explicit themes. The presence of difficult fictional themes does not by itself violate these Terms.
You are responsible for ensuring that your use of the Service and the material you publish or distribute complies with applicable law and respects the rights of others.
11. Uses That Are Not Permitted
You may not use the Service to:
- create, request, possess, or distribute child sexual abuse material or sexual content involving, depicting, or presenting a person under 18;
- facilitate sexual exploitation, human trafficking, or non-consensual intimate imagery;
- make credible threats, facilitate targeted violence, or provide operational assistance for serious wrongdoing;
- commit fraud, impersonation, phishing, doxxing, stalking, or unlawful harassment;
- create or distribute malware, malicious code, or instructions intended to compromise systems;
- infringe intellectual property, privacy, publicity, or other legal rights;
- scrape, probe, reverse engineer, disrupt, overload, or bypass the Service or its security, access, billing, usage, or rate-limit controls;
- sell, transfer, sublicense, or provide unauthorized access to the Service or an account; or
- use the Service in any other way that violates applicable law.
This section governs misuse of the Service. It is not a separate content-rating system for lawful adult fiction.
12. Service Protection and Account Enforcement
We may investigate suspected fraud, security incidents, technical abuse, or violations of these Terms using information that does not give personnel a manuscript-reading path.
We may apply proportionate measures such as limiting a feature, blocking a transaction, reversing an erroneous credit, requiring account verification, or suspending access. When reasonably possible and legally permitted, we will explain the measure and how to contact us.
We may act immediately when necessary to protect users, the Service, third parties, or legal compliance.
13. Free Access and Trial Somas
We may offer free access and a one-time allocation of 50,000 trial Somas to eligible new users. Trial Somas allow eligible AI-assisted operations and are subject to the limits shown in the Service.
Free access does not require a paid subscription and does not start an automatic subscription. A free account is not charged unless the user later chooses a paid offer and affirmatively completes its checkout.
Trial eligibility may be limited to one allocation per person or account and may be protected by reasonable anti-fraud controls. Trial Somas have no cash value, are not transferable, and cannot be sold or redeemed for money.
14. Paid Plans and Automatic Renewal
Before you purchase a paid plan, the price, currency, billing interval, included features, monthly Soma allocation, renewal terms, and cancellation method will be shown.
Checkout is hosted by Stripe and requires accurate billing information, including a complete billing address and postal code. Stripe may save that address to your Stripe billing profile for tax calculation, invoices, renewals, fraud prevention, and payment administration, as further described in our Privacy Policy.
By completing a monthly subscription checkout, you authorize the stated recurring charge until you cancel. New plans are billed monthly. A legacy annual subscription purchased while annual plans were offered remains governed by the billing interval and paid term shown in its original checkout confirmation.
Subscriptions renew automatically for the applicable billing interval unless canceled before the renewal date. Applicable taxes may be added. We will obtain the affirmative consent required by law before charging you and will provide a confirmation that you can retain.
We will provide renewal, price-change, and other subscription notices when required by applicable law.
You can stop future renewal through the online billing controls provided in your account. Cancellation does not delete your account or manuscript.
15. How Somas Work
Somas are usage units that allow eligible AI-assisted operations. They are not money, stored value, cryptocurrency, or property. They cannot be transferred, resold, exchanged, or redeemed for cash.
The Service may show an estimate before an AI operation. The applicable Soma amount may depend on the requested operation, selected writing voice, and material actually delivered. A request that is rejected, interrupted, invalid, not delivered, or technically unsuccessful will not result in a final Soma charge.
Somas included with a subscription refresh after confirmation of the applicable paid billing cycle. Unused monthly Somas expire at the next monthly refresh and do not roll over.
Where an account has more than one eligible Soma balance, expiring monthly Somas are used before non-expiring purchased Somas. We may correct ledger errors, duplicate credits, fraudulent activity, or charges that do not match the completed operation.
16. Soma Packs
When Soma Packs are offered, a paid subscription that is active and not past due is required to purchase and use them.
Each Soma Pack is a separate, one-time purchase. Packs do not renew automatically, and we do not perform automatic top-ups. Every pack purchase requires an explicit confirmation.
Purchased Somas do not expire while your account remains open. If the related subscription ends, is suspended, or becomes past due, unused purchased Somas remain recorded but become dormant. They become usable again when an eligible paid subscription is reactivated. Permanent account deletion removes remaining Somas without cash redemption.
A Soma Pack adds Somas only. It does not unlock a writing voice, feature, or access level that is not included in the active plan. Purchased Somas are used only after eligible monthly Somas have been used.
17. Plan Changes, Cancellation, Failed Payments, and Refunds
An upgrade takes effect only after successful payment. Unless the checkout states otherwise, a downgrade takes effect at the next renewal and does not retroactively remove access already paid for.
You may cancel renewal through Account, Billing, Manage Subscription, or through another online cancellation method we provide. You retain paid access through the end of the current billing period unless a refund, chargeback, legal requirement, or stated offer provides otherwise. A legacy annual plan continues its monthly Soma allocations through the already-paid annual term after cancellation of renewal.
If a payment fails, no new monthly Soma allocation is granted and new AI generation may be paused. Your existing projects remain available for viewing, manual editing, and export, subject to account security and these Terms. Purchased Somas remain recorded but dormant until the paid subscription is restored.
Cancellation stops the next renewal and normally preserves access through the end of the paid billing period. Cancellation by itself does not create an automatic refund or a prorated refund for unused time or unused monthly Somas.
We may review a refund request for your first paid subscription purchase if you contact us within seven days of purchase and no paid Soma has been consumed or reserved. We may review a Soma Pack refund request within seven days of purchase only if no Soma from that Pack has been consumed or reserved. Eligibility does not guarantee approval; Finance reviews each request against the payment and Soma records.
Duplicate charges, unauthorized payments, technical errors that prevent delivery of the paid Service, and rights or remedies required by applicable law are reviewed independently of those seven-day conditions. Mandatory consumer rights in your jurisdiction prevail.
Refunds are not issued automatically or from the customer interface. Submit a request tobilling@darkromancewrite.com. If Finance approves a refund, it is returned through the payment provider to the original payment method, and related access and Somas are neutralized through the controlled, idempotent financial process without duplicate deductions.
18. Service Availability, Maintenance, and Changes
We work to provide a reliable and secure Service, but we do not guarantee uninterrupted or error-free availability.
We may maintain, repair, update, or change the Service and may add, modify, replace, or discontinue features. When a change materially reduces a paid feature during an active paid term, we will provide notice or a remedy when required by law.
We are not responsible for delays or failures caused by events reasonably beyond our control, including internet outages, infrastructure failures, cyberattacks, natural disasters, governmental action, labor disruption, or failures of third-party services.
19. Third-Party Technology and Services
The Service relies on carefully selected third-party infrastructure, authentication, payment, and AI technology. These providers process limited information as needed to perform their functions and are subject to contractual, technical, or legal safeguards appropriate to their role.
AI providers receive only the material required for the operation you request, under the no-data-collection and Zero Data Retention controls described in Section 9.
Payment information is processed by Stripe through Stripe-hosted Checkout. Stripe collects payment credentials, customer name, and complete billing address for payment, tax, fraud prevention, invoice, and renewal administration. Lilith Studios does not receive or store your full payment-card number. Stripe's terms and privacy notice also apply to its direct collection, as further described in our Privacy Policy.
We may replace a provider or model when reasonably necessary for security, privacy, quality, availability, or performance, provided that the protections and commitments stated in these Terms continue to apply.
20. Suspension and Termination
You may stop using the Service at any time. You may cancel a subscription without deleting your account, or request permanent account deletion through the account controls described in our Data Deletion Policy.
We may suspend or terminate an account for a material or repeated violation of these Terms, fraud, non-payment, a serious security risk, a legal requirement, or conduct that materially harms the Service or others.
When reasonably possible and legally permitted, we will give notice and an opportunity to resolve the issue. We may act without prior notice when immediate action is reasonably necessary.
Account termination may end access to User Content. Export work you wish to retain before deleting your account or before the end of any notice period. Data deletion and limited retention are governed by our Privacy Policy and Data Deletion Policy.
21. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service or any Output will be uninterrupted, secure, error-free, accurate, unique, copyrightable, commercially successful, or suitable for your intended purpose.
You are responsible for your creative, editorial, legal, and commercial decisions and for maintaining independent copies of your work.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.
22. Limitation of Liability
To the fullest extent permitted by law, Lilith Studios and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business opportunities, goodwill, or data, arising from or related to the Service.
To the fullest extent permitted by law, our total aggregate liability arising from or related to the Service or these Terms will not exceed the greater of:
- the amount you paid to Lilith Studios for the Service during the 12 months before the event giving rise to the claim; or
- US$100.
These limitations do not apply to our fraud, willful misconduct, gross negligence, or liability that cannot be limited under applicable law. They apply regardless of the legal theory and even if a remedy fails of its essential purpose.
Some jurisdictions do not allow certain liability limitations. In those jurisdictions, the limitations apply only to the extent permitted by law.
23. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Lilith Studios and its officers, employees, contractors, and affiliates from third-party claims, damages, liabilities, judgments, and reasonable legal costs arising from:
- User Content you submit, publish, or distribute;
- your unlawful or unauthorized use of the Service;
- your material breach of these Terms; or
- your violation of another person's rights.
We will provide prompt notice of a covered claim when reasonably possible. You may control the defense with counsel reasonably acceptable to us, and we will reasonably cooperate at your expense. You may not settle a claim in a way that admits fault by us or imposes an obligation on us without our written consent.
This section does not require a consumer to indemnify us for our own unlawful conduct and does not limit rights that cannot legally be waived.
24. Informal Dispute Resolution, Governing Law, and Courts
Before filing a claim, you and Lilith Studios agree to try in good faith to resolve the dispute informally for 30 days. Send a notice to legal@darkromancewrite.com that identifies your account email, explains the issue, and states the resolution requested. You do not need to provide your full manuscript.
Either party may bring an eligible individual claim in small claims court without completing the informal process if waiting would cause the claim to expire or if immediate relief is legally available.
These Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict-of-law rules.
Subject to any non-waivable consumer right to bring a claim elsewhere, legal proceedings must be brought in a state court located in Sheridan County, Wyoming, or in the United States District Court for the District of Wyoming. An eligible small claims action may also be brought in Sheridan County or in the county where you live if that court has jurisdiction.
Nothing in these Terms deprives you of mandatory consumer protections or venue rights that apply in your state or country of residence.
25. Changes to These Terms
We may update these Terms to reflect changes in the Service, law, security practices, or our business.
For a material change, we will provide reasonable advance notice, generally at least 30 days when practical, through email, the Service, or another appropriate method. Changes apply prospectively from their stated effective date and do not retroactively alter completed transactions.
If applicable law requires renewed consent, or if a change materially alters the agreement in a way that requires affirmative acceptance, we will ask you to accept the updated Terms. Otherwise, continued use after the effective date constitutes acceptance of the updated Terms.
The effective date displayed at the top identifies the Terms currently in force.
26. Electronic Communications and Notices
You consent to receive account, security, service, billing, transaction, and legal communications electronically, including by email or through the Service. Electronic communications satisfy any legal requirement that a notice be in writing to the extent permitted by law.
You are responsible for keeping your account email current and for reviewing notices sent to it.
Marketing communications are separate from essential service and legal communications. You may opt out of marketing messages through the unsubscribe method provided, without affecting necessary account, security, billing, or legal notices.
Notices to Lilith Studios must be sent to the applicable address listed in Section 28.
27. General Terms
These Terms, together with any policies or transaction terms expressly incorporated into them, form the entire agreement between you and Lilith Studios regarding the Service.
If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver. Any waiver must be in writing and signed by Lilith Studios.
You may not assign these Terms or transfer your account without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the Service, subject to applicable law and continued protection of your rights.
These Terms do not create a partnership, joint venture, employment, agency, or fiduciary relationship.
If you send product feedback, you allow us to use it without restriction or compensation. Feedback does not include your manuscript or other User Content.
Sections that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, liability limitations, indemnification, dispute terms, and general provisions.
The official language of these Terms is English. If a translation is provided, the English version controls to the extent permitted by law.
